Planning With Power of Attorneys

GANDERSON LAW, P.C. drafts various types of “Power of Attorney” documents (Durable General Power of Attorneys, Durable Medical Power of Attorneys, and Special Power of Attorneys for specific and limited events).

Relying on his experience in Estate and Elder Law matters, Mr. Ganderson has gained much insight into the importance of a well drafted Power of Attorney. Many individuals desire a Durable General Power of Attorney and a Durable Medical Power of Attorney. These Power of Attorneys are important when an individual is not able to manage his or her affairs due to temporary or permanent disability, or mental incompetency. The individual, by executing a Durable General Power of Attorney and a Durable Medical Power of Attorney, is able to designate one or more persons to manage his or her affairs prior to becoming incapacitated. Also, an individual may need a Special Power of Attorney, such as in the event he or she travels outside of the country frequently, and is therefore not easily accessible with regard to an upcoming real estate transaction.

GANDERSON LAW, P.C. stresses the importance of drafting well written Power of Attorneys so that in the event an individual becomes disabled or incompetent, he or she can rest assured that the desired person has the authority to make the appropriate decisions with regard to all financial and business matters, medical care, and other matters. Nevertheless, one must be extremely careful when choosing a holder for a Power of Attorney, because the holder has the authority to do whatever he or she desires so long as the power is delegated in the Power of Attorney instrument.
